Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of beralabs.studio (the "Website") and any app published by Beralabs Studio ("Beralabs", "we", "us", or "our"), including Rummage (together, the "Services"). By creating an account, downloading, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Services.

2. Description of service

Beralabs Studio is an independent app studio based in London, United Kingdom. Rummage is a family game-finder app that helps you discover games you can play with items you already own, and includes features such as profiles, badges, streaks, leaderboards, following other users, and optional subscriptions. We may add, change, or remove features at any time, and some features may be released as beta or "in development" and could change or be discontinued.

3. Eligibility & age requirements

To create an account, you must be at least the age of digital consent in your country (13 in most regions, though this may be older where you live), or have a parent or guardian create and manage the account on your behalf. By creating an account, you confirm that you meet this requirement or that a parent/guardian has agreed to these Terms for you.

4. Accounts & sign-in

You can create a Beralabs account using Google Sign-In, Sign in with Apple, or a username and password. Whichever method you choose:

• You're responsible for keeping your sign-in credentials confidential and for all activity that happens under your account
• You must provide accurate information when creating your account and keep it up to date
• You must notify us promptly at support@beralabs.studio if you suspect unauthorised access to your account
• You may choose one username, and — as described in the app — a username can only be changed once every two weeks
• We reserve the right to suspend or terminate accounts that provide false information, impersonate others, or violate these Terms

5. Acceptable use

When using the Services, you agree not to:

• Violate any applicable law or regulation
• Impersonate any person or entity, or misrepresent your affiliation with anyone
• Harass, bully, threaten, or abuse other users
• Upload or share content that is unlawful, hateful, sexually explicit, or otherwise inappropriate for a family audience
• Attempt to gain unauthorised access to the Services, other users' accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Services, including through cheating, exploiting bugs, or automated scraping
• Reverse-engineer, decompile, or attempt to extract the source code of the app, except where permitted by law
• Use the Services for any commercial purpose we haven't authorised

We may investigate and take appropriate action against anyone who, in our sole judgment, violates this section, including removing content, suspending or terminating accounts, and reporting to law enforcement where necessary.

6. User content & community features

Rummage lets you set a username, avatar, bio, and other profile details, and interact with other users through following, leaderboards, and reviews ("User Content"). You retain ownership of your User Content, but by posting it you grant Beralabs a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it within the Services for the purpose of operating and promoting them. You're solely responsible for the User Content you submit, and you confirm you have the right to share it.

You can control the visibility of certain profile details (such as your last name) through the app's privacy settings. We may remove User Content or restrict community features at our discretion if we believe they violate these Terms or applicable law.

7. Subscriptions, purchases & affiliate links

Rummage may offer optional subscription tiers and in-app purchases. These are billed and processed by the Apple App Store or Google Play, and are subject to their respective terms and payment/refund policies — Beralabs does not directly process or store your payment details. Subscription pricing, renewal, and cancellation are managed through your App Store or Google Play account settings.

The app may also display affiliate links to third-party retailers for games or items you might want to buy. If you make a purchase through one of these links, Beralabs may earn a commission at no extra cost to you. We are not responsible for the products, pricing, or service quality of third-party retailers.

8. Intellectual property

The Services, including the Beralabs and Rummage names, logos, mascot ("Bandit"), design, software, and content we create, are owned by Beralabs Studio or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited licence to use the Services for their intended purpose, no rights are granted to you in our intellectual property.

9. Third-party services

The Services rely on third-party providers, including Google and Apple for sign-in, Apple's App Store and Google Play for distribution and payments, and affiliate networks such as Awin. Your use of those providers' own services is governed by their respective terms and privacy policies, and we're not responsible for their acts or omissions.

10. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure, or that game/content recommendations will always be accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, Beralabs Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us, if any, in the twelve months before the claim arose. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or fraud.

12. Termination

You may stop using the Services and delete your account at any time from within the app's settings, or by contacting us. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you've violated these Terms, created risk or legal exposure for us, or if we discontinue the Services. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Changes to the service or these terms

We may update these Terms from time to time to reflect changes in our Services or for legal, operational, or regulatory reasons. If we make material changes, we'll notify you by updating the "Last updated" date above and, where appropriate, through the Website or within the app. Continuing to use the Services after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales, without regard to its conflict of law principles. You agree that the courts of England and Wales will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where mandatory consumer protection law in your country of residence gives you the right to bring a claim in your local courts.
